I. Personal Data

Only personal data necessary for carrying out and processing the agreed services are collected or those voluntarily provided by you.

Personal data includes any information that contains details about personal or factual circumstances, such as name, address, email address, phone number, birth date, age, and gender.


II. Legal Basis for the Processing of Personal Data

Where consent is obtained from the individual concerned for processing personal data, Art. 6 para. 1 lit. a of the EU General Data Protection Regulation (GDPR) serves as the legal basis.

For data processing required to fulfill a contract, of which the individual concerned is a party, Art. 6 para. 1 lit. b GDPR serves as the legal basis. This also applies to processing required to carry out pre-contractual measures.

Where data processing is necessary to comply with a legal obligation, Art. 6 para. 1 lit. c GDPR serves as the legal basis. If vital interests of the individual concerned or another natural person necessitate the processing of personal data, Art. 6 para. 1 lit. d GDPR applies.


III. Information and Deletion

Personal data will be deleted or blocked as soon as the purpose of storage no longer applies. Data may be stored if required by EU or national regulations. Data will also be deleted or blocked if a legally mandated retention period expires, unless further storage is necessary for contract conclusion or fulfillment.

Please notify us of any changes to your personal information.

You have the right to withdraw consent for the use of your personal data at any time. Requests for information, deletion, correction, objection, and/or data transfer (if not disproportionate) may be directed to the address listed in section XI of this statement.

If you believe your data protection rights have been violated, you may lodge a complaint with the appropriate supervisory authority. In Austria, this is the Data Protection Authority.

IV. Data Security

We protect your personal data with organizational and technical measures, particularly against unauthorized, unlawful, or accidental access, processing, loss, use, or manipulation. Despite high diligence standards, we cannot exclude the possibility that information provided via the internet may be viewed and used by others.

Please note that we are not liable for information disclosure due to errors not caused by us in data transmission and/or unauthorized access by third parties (e.g., hacker attacks on email accounts, intercepted faxes).


V. Use of Data

We will not process data provided to us for purposes other than contract fulfillment. Exceptions include use for statistical purposes if the data has been anonymized.

Also exempt are data received in connection with our app ForgTin, including the online questionnaires TSCHQ (Tinnitus Sample Case History Questionnaire) and somatic tinnitus. User and progress data provided to us is stored in anonymized form for research and development purposes (e.g., medical studies and evaluations). Use for other purposes is not permitted. Customers may withdraw consent at any time.

Email Advertising with Newsletter Subscription

If you subscribe to our newsletter, we will use your provided data to send regular email newsletters. You may unsubscribe at any time by contacting us through the means listed below or by using the link provided in the newsletter. After unsubscribing, we will delete your email address unless you consent to further use of your data or if legally permissible use applies.

VIII. Cookies

This website uses "cookies" to make our services more user-friendly, effective, and secure.

A "cookie" is a small text file that we transmit from our web server to the browser’s cookie file on your computer's hard drive. This allows our website to recognize you when you reconnect. Cookies help us determine usage frequency and the number of users on our website. The content of the cookies we use is limited to an identification number that does not allow personal identification. The main purpose is to recognize website visitors.

You can set your browser to inform you about cookie settings and allow cookies only on a case-by-case basis, reject cookies for certain cases, or generally, and automatically delete cookies upon closing the browser. Disabling cookies may limit the website's functionality.

On this website we use the Facebook Pixel of Facebook, a social media network of the company Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland. This can be used to improve Facebook advertisements. The collected data is not visible to us but can only be used in the context of advertisements. By using the Facebook Pixel Code, cookies are also set.

We use Hotjar on our website from Hotjar Limited (Level 2, St Julian’s Business Centre, 3, Elia Zammit Street, St Julian’s STJ 1000, Malta) to statistically analyse visitor data. Hotjar is a service that analyses the behaviour and feedback of you as a user on our website through a combination of analytical and feedback tools. Hotjar provides us with reports and visual representations that show us where and how you “move” on our site. Personal data is automatically anonymised and never reaches Hotjar’s servers. This means that you are not personally identified as a website user and we learn still a lot about your user behaviour.

While you browse our website, Hotjar automatically collects information about your user behaviour. In order to be able to collect this information, we have integrated our own tracking code on our website. The following data may be collected via your computer or browser: IP address of your computer (in anonymised form), screen size, browser information, location, language setting, websites visited (subpages), date and time of access to one of our subpages (web pages).

In addition, cookies also store information that is placed on your computer (usually in your browser). They do not collect any personal information. As a matter of principle, Hotjar does not disclose any information it collects to third parties. However, Hotjar explicitly points out that it is sometimes necessary to share information with Amazon Web Services. In that case, some of your information is stored on their servers. However, Amazon is bound by an obligation of confidentiality not to disclose this information.

We have built in a tracking code on our website, which is sent to Hotjar's servers in Ireland (EU). This tracking code contacts Hotjar's servers and sends a script to your computer or device that you use to access our site. The script collects certain information about your interaction with our website. This information is then sent to Hotjar's servers for processing. Hotjar has imposed a 365-day data retention period on itself. This means that all information collected by Hotjar and older than one year is automatically deleted.


IX. Server log files

In order to optimise this website in terms of system performance, user-friendliness and provision of useful information about our services, the provider of the website automatically collects and stores information in so-called server look files, which your browser automatically transmits to us. This includes your internet protocol address (VIP address), browser and language setting, operating system, referrer URL, your internet service provider and date/time. This data is not combined with personal data sources. We reserve the right to check this data retrospectively if we become aware of specific indications of illegal use.


X. Google Analytics

This website uses Goolge-Analytics, an advertising analysis service provided by Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, on the legal basis of overriding legitimate interest (analysis of website use). For this purpose, we have entered into a data processing agreement with Google.

When you visit our website, software establishes a connection to Google's servers and transmits data, some of which are located in the USA. Google Analytics also uses cookies to store information about the website user and to analyse the use of the website.

This website uses the "IP anonymisation" function. In this way, your IP address is truncated and thus anonymised by Google within member states of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there.

According to Google, Google will use the collected data to evaluate the use of the website, to compile reports on website activity and to provide other services related to website and internet usage.

Google may also transfer this information to third parties where required to do so by law or where such third parties process the information on Google's behalf.

You can generally prevent the collection of your user data on our website by setting your web browser “Do Not Track”. Our website takes into account the “Do Not Track” signal, which then sends to all websites via browsers.
